Arizona To Seize Federal Land?

"Ariz. Senate OKs bill on seizing federal property

PHOENIX (AP) -- The Arizona Senate has approved a bill to give the state legal authority to go to court to take ownership of land owned by the federal government.

The Senate's 20-9 vote Monday sends the bill to the House.

Sponsored by Republican Sen. Al Melvin of Tucson, the bill is one of many states' rights measures being considered by the Republican-led Legislature.

Under the bill, the state could use the power of eminent domain to acquire federal property unless it was acquired by the federal government with the Legislature's consent.

The land taken through eminent domain would have to be used for a public use that increases the state's ability to generate revenue or helps the state's trust land system.

Seems like Arizona, and the Feds really dont like each other, can they break off and start their own republic for the Arizona People, I know if they did that, a whole lot of people would want to live there. ????

Do you really have easy prospecting access to state land now? Why not???? Do you feel it would get better???? If you really think that it would get better if the BLM land was transferred and became part of AZ state land, you really don't understand the situation do you??? If it was just AZ trying this, I would sit back and laugh, but now Idaho and Utah are also attempting it. I suspect Nevada is thinking about it also. So, it seems your republican governors are paying back big business for the support while they can and the little guy is going to lose. With a republican supreme court in place now, it just might happen.

Before it is over with, your states could become like Texas where there is no access to federal land. Since you don't have access to state land without big bucks behind you now, well......... If that is what you want, have fun. I will just sit back and enjoy the stupidity in progress.

Dave, you remind me of a guy I knew who lived in Ruidoso NM who ran a small prospecting shop. He had a couple of claims that he used to promote his little business. Well, he bitched and bitched about how bad it was under the BLM because of various restrictions, and how he would be so happy he didn't have to deal with them any more. It is too bad I lost those emails, I think you would have enjoyed them.

Anyway, in the end, the BLM turned over control of the epa enforcement to the state. Within 24 hours, the guy was shut down and threatened with jail time if he turned another shovel full of dirt. He was ordered to do thousands of dollars worth of improvements plus post a huge bond before he could continue. That ended his business right there.

If you think it would be any better in your state, you better read up on your state land use requirements and what is necessary. I think you will be shocked at what you find. Next, don't be surprised if the newly acquired state land quickly becomes private owned by big mining business, or if nothing else, leased by them.

As for becoming a country of your own. Since AZ doesn't pay its own way now because of a lack of an industrial base, well the US would win in that deal. AZ has a deficit now, and without fed support, it should be fun to see how the new country would survive. Even with huge tax increases, it wouldn't but that is ok. It would teach the rest of the states something.

Well, this will most likely end up in the supreme court and recent rulings sure point to a high probably of the states winning. Remember, it is a conservative court at this time.

So, pigs just might fly before it is over with.

You nailed it with your post about New Mexico. They usurped the feds control in the late 80's and made it stick. No one prospects on any land whether it is private, public, state, or otherwise without a state permit. I hear a lot of noise about "that cant be done" but they did it years ago and it stuck.

And yes, it is my belief that the current adminnistration (a Republican one) will allow the large mining and oil interests to have their way and completely strip the samll operator of any rights they may still have. It costs $10,000 for a state permit to move more than a couple of yards of dirt in one year here. That has effectively killed any small mining but is not a problem at all for a large company. And that is over and above any additional FEDERAL rules.

"When pigs fly". Our favorite Reepublican governor coined that phrase ten years ago. Pigs have been flying since. But very little dirt.

Reg I like you and wish nothing but good things for you. But it's almost easier to mine state land than BLM or Forest service land in Az anymore. The tree huggin sierra club socialistic democratic party have been working at kicking us off our own lands through over regulations and with drawls and multitude of other stupidity's. I just hope for your benefit Colorado elects some tea party types that can repeal some of the crap you have up there as well. We in Az enjoy visitors from Colorado especially when they don't have a socialistic agenda cuzz I ain't sharing my finds evenly with you or them. You have to grow some gonads and go out and find your own !!

What is this thing about Pima county wanting to break away from AZ and form its own state? If they do, I wonder what the state laws will be for gold hunting? It seems there are quite a few people there that have common sense and real gonads. So, if they do break away and become their own state, do you plan on moving back to the redneck state of AZ? He he he.

I'd like to see the heartland (everything between the big cities on the east & west coasts) secede from the union and roll back the rules & regulations to what we had in the 60's. Then this country could get back to mining, manufacturing and cutting timber. :twocents:

Reg the crazy socialists (Sheriff Dumshit) and immigration fanatics ( Raul Grajalva and his amigos) want to create a new state so there will be no control on immigration, drugs and human smuggling. So they will have a clear passage to Colorado !! At least Gabby is out of our state now !! These and other liberal spending bozos have nearly bankrupted Pima county and Tucson and allowed the trashing of our southern deserts. If it were to actually happen all mining, prospecting and business in general would be killed. We'ld all become beggars, smugglers or cartel targets. Just my happy thoughts ? Happy Huntin John B.
