THE FEDERAL MINING LAW > 30 U.S.C § 22. Lands open to purchase by citizens

Except as otherwise provided, all valuable mineral deposits in lands belonging to the United States … shall be free and open to exploration and purchase, and the lands in which they are found to occupation and purchase, by citizens of the United States … under regulations prescribed by law, and according to the local customs or rules of miners in the several mining districts, so far as the same are applicable and not inconsistent with the laws of the United States.

Public land under the ownership of the United States. “The power over the disposition of such land and the minerals contained therein is in Congress and not in the states“. (McLemore v. Express Oil Co. (1910) 158 Cal. 559, 562; Moore v. Smaw (1861) 17 Cal. 199, 218-219.) ........................ :olddude:

It won't be that easy to just change the mining laws for the purpose of their agenda. That article is inacurate in many places, there are many regulations designed to protect public interest and the environment, to prevent polution by mining operations and still allows responsible mining. As far as the part where they are taking a billion dollars virually free, the mining law was purposefully designed that way by congress, to be free and open to all citizens. And it is not free, the minerals are taxed, its called income tax, and the operations and environmental impact reports all cost a lot of money, not to mention the specialists these companies must hire to navigate the 100s of State and Federal rules and regulations, then pay for the actual operations to mine these natural resources.

Besides, these large mining companies have more money for lawyers and lobbists than us small scale miners.

Here is what those anti-mining people overlook, or ignore.

The American mining system is the most productive & environmentally regulated in the WORLD.

Besides federal regulations, if you include each state & county regulations, there are over 2,831 laws that protect the environment from mining.

The American mining laws gave us the ability to win WW1, WW2, and every conflict since then.

American mining laws made the American dream possible.

Phosphate is mined. It is the primary agricultural fertilizer of almost everything we eat.

Increase the cost to mine that, you will instantly increase the cost of our food.

Add a 7% tax on mining, you add a 10% cost increase on almost everything produced in America.

Changing, or continuing over-regulating American mining will be the death of the economic power of this nation.

TAKE A QUICK LOOK AT THIS LINK:

They should make this a BUMPER STICKER:

THIS SHOULD BE TAUGHT IN OUR SCHOOLS.............. :olddude:

I mean they won`t even let me post a reply because of when we were fighting them about SB670.

They don`t listen to anybody, They walk around with blinders on.

Maybe somebody can post the above on their replies

I tried as well and wasn't allowed, and I never commented there before, but I have commented on numerous other websites of this same type of organization. I wonder if they share info (i.e. IP addresses) on who's posting comments opposing their views, this is not the first time I was not allowed to post a comment where I have never posted one before!!!

This is the same type of “news” pabulum used to inform the uneducated masses of people by the likes of those that supported SB670 e.g. Sierra Club, Sierra Fund, Cal Trout etc. using articles such as this that appeal to human emotion using scare tactics “the sky is falling, the sky is falling” and untrue inferences that hold no substance to reality.

I'm glad to see it posted and commented on here, because the emotional side is a lot easier to grasp onto by JQ Public than the factual side of science and other outstanding issues as pointed out here.
